QUESTION

Lawyer signed Affadavit without my consent

Asked on Nov 06th, 2014 on Family Law - New York
More details to this question:
We had 7 days to file a response to opposition motion papers. My lawyer was unresponsiveness and ignored all requests to meet to prepare papers. The night before the papers were due my lawyer told me that due to time constraints she had to sign my Affirmation and accused me of holding up this process. She refused to allow me to review or send papers submitted to the court and now I still don't know what was included and do not have a copy of the response. I told her I did not give consent to her signing the affirmation. She did anyway. Is this allowable?

No. But you should carefully consider your next steps - presumably showing what was submitted to a different attorney.
