Legal separation

More details to this question:
My brother and wife are not living together. She has a pension that she wants to get a legal separation. Since he is her husband she does not want to get his permission every time she get a disbursement because he is her husband. He has MS and bedridden. He lives in Massachusetts and she is in New York. what rights does he have.

Are they legally still married?, separated i.e separate support in place? any court orders? agreements between the parties? does the disbursements require his signature? otherwise, accounting and division of marital assets (including arrears) will take place at Divorce or in the Separation Agreement.
