QUESTION

Marital Home

Asked on Jul 14th, 2014 on Family Law - New York
More details to this question:
I was awarded no alimony in my divorce as my salary was higher than my husband's and I had a professional position. I received a small amount of child support inconsistently. I have paid the mortgage and repairs, maintenance and upgrades as my husband verbally told me that my upgrades would be deducted from the proceeds. Now that the house is for sale, he has changed his mind and does not want to provide consideration for required repairs, maintenance and upgrades. I live in New York State. I have fully paid the mortgage and property taxes for more than 15 years; of course, maintenance, repairs and upgrades, which we had agree upon, were required. Now, after doing so much, he and his attorney say he ought to get 50 percent of the proceeds.

If you made a separate property contribution you can recover the value of that contribution. However, if you contributed salary only or marital assets you are entitled only to an "equitable" share. What equitable is can be argued... but arguing pro se against an attorney is unlikely to yield very good results.
