More details to this question:
We are from Brazil, married in Brazil, but living in New York for 6 years. We didn't get married here, but now we are buying an apartment, since I'm pregnant. What's my rights here in US if we get a divorce? The apartment is in both names, we are buying together, but his mother is giving him an amount of money - a gift from heritage - to help us with the downpayment. But now he wants to make sure that I don't have rights related to this gift from his mother. Do I have to do a contract to make things clear? Which rights do I have in case we get a divorce here? My marriage certificate is valid here?

Your marriage certificate is certainly valid. Under New York law in a divorce you would be entitled to child support, and, depending upon the circumstances, a share in the equity in the apartment and possibly spousal support.
