More details to this question:
My wife and I separated last year in October, i moved out and continued to pay rent, cable and the light bill as support for her and rent on my own in a different apartment for Nine months. I originally had filed for Divorce last year and then dismissed it due to trying to reconcile while living apart. It did not work out and now she is asking for me to pay her alimony her $900 a month for 2 years, wants half of my pension. Am i able to include the amount of months I continued to provide help support to her into the amount of years she is asking for alimony? I wanted to know if I could lower the amount of years she is asking for support. We do no have kids. Please any insight would be greatly appreciated . Thank, Jasmine
Thank you for your question. There are many factors to consider when determining whether an award of alimony is warranted, and if warranted, the duration and amount of same. The duration of the marriage and your financial circumstances are only two factors. You may be able to negotiate the retroactive support that you provided; however, I will not be able to give you a more definitive answer without knowing more about your case. For example, what is the need for alimony? What was the standard of living established during your marriage? These are just a few more factors that are used when determining alimony. I strongly encourage you to schedule a consultation with an experienced family law attorney. I hope this information was helpful to you.
