QUESTION

Modification to Final order of divorce

Asked on Mar 17th, 2015 on Divorce - Massachusetts
More details to this question:
I got my final judgement order for divorce in Jan 2015. I have physical custody of my 3 yr old and I share legal custody with my ex spouse. The final order does not clarify on drop of and pick up and though my ex was doing drop off and pick during Temp order he refuses to do it now. I wanted to file contempt because it is implicit that visiting parent should do drop off and pick up but the court clerk said you will have to file a modification. What should I do? PS - I had a very messy divorce and went through a trial.

If the final order does not address the issue of the pick up and drop off, then you should consider filing a motion to modify the final order.  Before you do so, you should first attempt to resolve the issue with your ex-spouse.  Even if it is not likely that your ex will agree, at least the court will see that you made an effort to resolve it without filing a court action.  Please let me know if you have any other questions.  Many thanks.
