I have a question in reference to modifying child support. I petitioned to have the support modified about 11/2 years ago and it was reduced ( I was looking to have it increased) It was not a significant reduction, $10 per month. At that time, I was claiming, I believe 7,000 per year, self employment. My paper income is now zero. I live in Ohio. My son, was diagnosed years ago with Asberger's Syndrome. We do not go to therapy.. he refuses. Last May 2, 2013, I withdrew him from traditional (public) schooling due to bullying which has had quite an impact on him mentally. I am now homeschooling (online k12) this year and what a difference.... He once locked him self in the bathroom at 7:30 am and took a sleep aid because of his fear to go to school... this was it for me... His father sees him (lives a whole 15 mins away) approximated 4 times per year, give or take. I am now spending most of my day homeschooling and trying to instill some self-esteem back into my 13 year old son. With that said, would the above change in circumstances support a reason to have the child support modified? Increased? The father's earnings are somewhere in the ballpark of 70,000 annually... I would have to look. My earnings are imputed, hope that is the correct word. I need to be here for my son for school ( 6 plus hours daily) and support... trying to get him back on track.... Thank you for any advice...
I do think that you have the changes of circumstances to have the support reviewed again. One thing I would also do is ask for more child support due to the fact that the Father does NOT see the child or have the child with him (as much as implied when the child support is determined) and is NOT spending on the child the amount which the guidelines assume he will spend!
