In divorce papers we have the morality clause for after 10pm and overnight visits. If both parents agree we would like to take this out of papers and not go by it how would we go about doing that? type something up and have it notarized? have to go back to court?

You should put the agreement in writing. Whether you file it with the court or not depends on whether you think your ex will try to use it against you later.
