QUESTION

Mother keeps all Child Support

Asked on Aug 21st, 2013 on Child Support - Massachusetts
More details to this question:
My father divorced my mother about 4 years ago. In the divorce he gave her the house and pays both alimony and child support of $4000+ a month. There are 4 children, in which my father pays $600 for each child. During the past 4 years we all moved out and attended college. My sister and I have turned 26 and by law my father should not be paying for us anymore, he wants to give us the money directly so we can afford better apartments. Besides food, my mother never used any of that money on us. She has refused the past 2 years to pay for our colleges, hospital bills, insurance, or even loan us money. The house is easily worth $500,000 even if its a foreclosure. So my father is paying all our bills on-top of the money he sends her. My father's lawyer told him, that unfortunately, if he tries to go to court, she could claim that she is jobless because of him and get more money taken out. I was wondering if there was a way the children could claim against her.

You cannot receive the money directly from your Father. You can have your Father get a second opinion regarding his support obligation. Depending on the terms of the agreement, your Father may or may not have options.
