Moving out of State

More details to this question:
I have full physical custody of my 11 yr old son. His father has limited visitation; 1 weekend a month plus my son spends the entire summer with him. We (my ex & I) have no custody agreement filed with the court. Everything so far has been verbal. I have an opportunity to move from NJ to FL within the year. My ex is saying that he will not let my son move to FL (my ex lives in PA). However, 2 years ago my ex decided to move to CA without blinking an eye. It didn't work out after approx. 5 months & he moved back to PA. He had no problem moving across country then; which affected his visitation. Since there isn't a court order, am I going to have any issues just moving to FL?

I have seen your question. My name is David Salvaggio.  I head a law firm that devotes its practice exclusively to New Jersey Family Law matters, including relocation applications.  It's all we do. Unfortunately, unless your ex provides you with written consent to your proposed move to Florida with your son, you must have an application properly prepared, filed and served, seeking a Court Order permitting the move with your son. I recommend that you meet as soon as possible with a very experienced lawyer who devotes his/her practice exclusively to New Jersey Family Law matters such as yours.  Go over your situation in detail with the attorney, get educated answers to your questions, and obtain expert guidance as to the best course of action. In my opinion, it will be well worth the cost of the meeting.
