In order to modify custody in Maryland, you must show a material change in circumstances and that a modification is in the best interests of the child. The preference of the child is usually not considered when determining whether there is a material change in circumstances.
Now, if there has been a material change in circumstances, the child's preference will be considered when the court attempts to determine the second prong - the best interests of the child. But you must show a material change in circumstances before the court reaches that bridge.
