My mother and her husband have lived in their home for over 35 years. It was his before they were married. They moved to an assisted living.

He is selling HIS house. Does my mother have any claim to the proceeds, she has dementia and may need extra care in the near future. They have kept their finances separate.
Your mother may have a claim for some of the proceeds from the sale of the house. Was there a mortgage on the house at the time that they were married? If there was a mortgage, community funds were presumably spent to pay down the mortgage, which would likely give her a partial claim.
