my sister is having custody issues...

More details to this question:
my sisters husband is in the navy and is being stationed in Hawaii but my sister is having trouble with the father of her eldest son, he has made no effort to see his child in over a year, has no job, and is 24 and already filling for social security benefits... is there anyway to get him out of the picture so he doesn't cause anymore grief for her?

Fathers have the right to visit their children. New York state does not provide a way to terminate parental rights, unless there is abuse/neglect and both parents are losing the child. Your sister needs to petition for the right to move with the child out of NY. The court will help her and the father set a schedule, or she can request that she be allowed to decide when the father can see the child. If he hasn't been seeing the child at all, the court may allow her to decide if and when the access will be allowed. Good luck.
