QUESTION

No contest plea

Asked on Mar 19th, 2013 on Family Law - Michigan
More details to this question:
I currently have a case going against a girl who assaulted my daughter. She plead no contest today when the judge denied her a non-formal hearing because of the severity. The prosecutor told me she will more than likely plead no contest when we go to pre-trial because they are worried about a civil suit. if for some reason she is found not guilty to the assault charges will I get the money we are requesting the family to pay us back in restitution?

If the Defendant is found guilty, either by plea (including no contest) the court will order her to pay reasonable restituion. So you will be reimbursed for losses that flow directly  from her actions, and that are not reimbursed by another source. If on the other hand she is found not guilty, she will be under no obligation to pay you any money. if you feel that you have a valid claim you will have to bring your own lawsuit against her.
