QUESTION

not married fathers rights to child

Asked on Dec 28th, 2013 on Child Custody - Georgia
More details to this question:
Mother and father never married to each other. They don't live together and no child support is paid or asked for by the mother. The child has mothers last name, lives with mother and insurance paid by mother. Only thing father is noted on is birth certificate. What are fathers rights over child? Nothing has been taken through court system.

As a general rule, a father that is unmarried to the child's mother has no parental rights until the child is "legitimated" by the court. Therefore, it sounds like he would need to file a petition to legitimate. A lawyer can help with this. If that is granted, he would then be able to ask for specific visitation rights.
