My husband and I recentley separated and he threatened my life. I got a order of protecrion against him. Last year he bought a pistol and gifted it to me for protection. He is a Truck driver and wanted me to be safe. Since I have that Order against him Do I have to give him the gun? He has refused me trying to give it back to him previously. He also stated it was transferred over to me but now says the gun is actually in his sons name. Will I get charged for having that gun as he is threatening to have me charged with theft of this gun. What are TN laws on this matter since we are still legally married
If it was a gift, then you can not be guilty of theft. If he is under an order of protection, then he is not allowed to have possession of any weapons so do not give it back to him.
