QUESTION

out of state visitation rights

Asked on Mar 17th, 2014 on Child Custody - Pennsylvania
More details to this question:
My 14 year old sons father has had nothing to do with him all his life. Upon his birth I was living in Ohio. Child support and Dna was established in Ohio. We were never married. When my son was 3 I moved to PA. Yesterday I received a motion for " allocation of parental rights and responsibilities." A family member of mine who is friends with his lawyer found that he is looking for visitation and wants it in writing. I am also asking for a change of venue from OH to PA. What are the chances of change of venue being granted? How does out of state visitation work? Does a court just grant visitation to a parent that has been absent by his choice? My son feels uneasy by the idea of visiting someone he doesn't know.

Your chances of having it moved to PA are excellent, as the place where the child has lived for the past 6 months is the home jurisdiction of the child. If the facts are as you present them, I believe the court will grant the father very little time at first--perhaps 3 hours on 2 Saturdays a month, and then schedule a review conference to see how that's been going.
