More details to this question:
Hello, Back in 2002 the mother of my then 2 yr old son, took my son to Puerto Rico without my consent. I presented this case to the commonwealth of Massachusetts where the courts ordered me custody of my son. She defied several court orders to represent herself to the courts. I attorney at the time advise me to hire a lawyer in Puerto Rico but the courts there would not honor the courts orders here in Mass. I recently discovered that my son is no longer in PR but in Louisville Kentucky. Can I still present my case? What are my right?
Dear Anonymous,
I am sorry to hear about your situation. If you received a Judgment granting you custody, then it should be valid. The Uniform Interstate Family Support Act (UIFSA) governs the case and the case is still presentable.
