Asked on Feb 19th, 2013 on Child Custody - New Jersey
More details to this question:
My wife and I have a 4 y/o daughter. I have been there all of her life my name is on the birth certificate. There is one other guy who could be the father. I'm in the military and my wife and I live in LA, and the other guy lives in NJ. He was told she could be his when my wife first found out she was pregnant and he didn't want anything to do with her or the situation, and now he is trying to fight for partial custody. Does he have any legal rights now 4 yrs later. she knows me as daddy, I have raised her, put food on the table, a roof over her head, resussitated her at 3 days old, and he has only meet her 3 time 2 of which were in the last 2 wks, and the first time was when she was a week old and he told us that he still didn't want anything to do with her.
You say that the other guy is trying to fight for partial custody. If--as I suspect--there are ongoing court proceedings in California, you need to see a lawyer in California.
Although it seems unlikely that there are ongoing court proceedings in New Jersey, if there are such proceedings, you may be able to get them dismissed for lack of jurisdiction, and you should contact me to provide me with more information.
