QUESTION

Paying child support for multiple children...

Asked on Dec 30th, 2013 on Child Support - California
More details to this question:
I have 4 children with my husband. We are filing for legal separation. He found out he had a kid with another woman that he was unaware of about a year ago...that kid is now 12. He has been paying child support for the kid via automatic payroll deductions. Now that I am filing for separation and asking for child support along with alimony (been married 8 years) I was wondering if the other parent will still receive the same amount of child support or if it gets reduced due to him paying for my children now? I have severe medical issues and am set to have whole colon removed next month...I have been unable to work for a while. Our son has disabilities as well....does this entitle us to more support? The other mother is constantly trying to get more money...how will this affect me and my kids now? Also I will have the kids 99%. He will rarely see them as per agreement.

You'll want to go to the Family Court Facilitator at your county courthouse if you are self-represented, as that is a free service with an attorney to advise you how to go forward.   There is no "legal separation" in California as a step towards divorce.  You can file for divorce or you can file for a judgment of legal separation. If you file for a legal separation, it is fully like a divorce except that the status of the marriage stays intact--- in other words, you are still married when the judgment is made. If you do file, you will want to go to the Department of Child Support Services in your county- they can help you with both setting support and collecting support.
