Judge order a Permanent Restraining One was issue to me by my daughter. Now i can't see my Grand Children. It has been over a year. My grand Children were very close to me. The Oldest Lived in my Home with her mother, until the age of two. Took care of them often. I had called Child protective services. she was smoking weed and out of control, Mentally abuse them. That is when she said I would steal her kids, and a temp one was issued. But i broke it because i could not stay away and would drive by just to see if i could see them. broke the order over and over again. I really did not know what 1000 ft was and did not think my daughter would really put me in jail.
There are no "Granparent Rights" in the State of New Jersey. Although the grandchild lived with you, your daughter lived with you as well so you were not acting as a custodial parent. The law says that the parents have a right to raise their children the way they want, including whether or not they visit with the grandparents. However, if your daughter is an unfit parent, that's something you could bring to the court's attention, and possibly seek to have the child removed. You cannot go to court an ask for visitation rights because you are the grandparent. Defying the restraining order will only lead to you being arrested.
