Proof of Residency

More details to this question:
I want to get a divorce from my husband who is in FL, while I just moved back to NY. We were married in NY and my drivers license is still from NY (my husband was military so we've moved a few times, but I've never changed my license). Since my license is still NY issued, can I use that to prove my NY residency to file for divorce instead of waiting a year from the date I moved back here?

It's not clear from your posting whether you in fact meet the NY residency requirement. If you try an end run around the requirement he may oppose the divorce on grounds of jurisdiction.
