QUESTION

Regarding protective orders in Texas.

Asked on Jan 09th, 2014 on Family Law - Texas
More details to this question:
A few months back, my boyfriend and I had gotten into a fight that turned physical on both ends. Long story short, the neighbors called the cops due to my screaming. During the fight I had been choked. We resolved the argument and had moved on by the time the cops arrived. He was arrested. At the time I was still mad so I chose to have charges pressed. Later I dropped them. About two weeks ago I decided to move in with my mom. My mom told me that I needed a protective order in order to live under her roof. So, I filed for one and was granted a temporary one with a court date in a few weeks. He and I have both decided to stay committed to each other but I'm terrified of this protective order. What can I do to convince the judge it's not necessary? Please help.

It is best to go to the hearing and tell the proscecutor and judge that you do not need the order. They should follow your wishes. Notify your boyfriends attorney so he can be there if possible.
