I have sole physical and legal custody. Our custody order states visitation is suspended for non-custodial parent. Am I required to send a notice of intent to relocate out of state to the non-custodial parent? In addition, he has not seen or spoken to the children in two years, and is currently incarcerated.

Yes, he still technically has custodial rights even though they've been suspended. If he doesn't consent to your relocation, I don't see much trouble in convincing the court to allow you to relocate.
