QUESTION

Separation/Divorce

Asked on Jul 11th, 2017 on Divorce - Virginia
More details to this question:
Married for 11 yrs. Have 1 child together and she had 1 from a previous marriage. Both of us are miserable and we need to separate. Can't do that until our house sells (it is on the market currently). I was the breadwinner for about 5 yrs until she went back to work part time. She is college educated, has professional certifications, and made good money prior to staying home. I know that I will have to give her half of our financial worth, as well as pay for child support and spousal support. I just want joint custody of our child and 50/50 split time. Additionally, I don't want to be taken to the cleaners in child/spousal support. We don't have much debt besides the house, and don't have many large assets. Just need some reassurance from a lawyer.

I'm not sure what your question is, but it seems that you have a realistic view of how things will be resolved.  Anything that you acquired during the marriage is presumably marital and will most likely be split 50/50, although in Virginia the court has some discretion about that, if the two of you cannot agree  But it generally comes out 50/50.  Splitting custody 50/50 can be a little trickier, unless the two of you can agree to it, because most judges will feel that the child needs one primary home.  You will want to be sure to try to work that out with the mother rather than to to court, unless you want a full-fledged custody battle.  You will want to find a lawyer close to where you are located to discuss working out a settlement.
