QUESTION

Settlement

Asked on Jan 26th, 2022 on Divorce - Pennsylvania
More details to this question:
My soon to be ex husband totaled my 2010 vehicle titled only in my name. He feels that it’s his car and he should get the entire settlement since he let me have the newer car also titled in my name. I have paid for both vehicles. I said I would split the money and he said it’s all his?

Marital property is defined as property acquired from the date of marriage to the date of separation.  If the cars were bought during the marriage, regardless of title, they are part of the marital estate.  If bought prior to marriage, they are all yours. Marital property is divided one of two ways in a divorce, agreement or court order.  If the two of you cannot agree, the court will have to resolve it.
