Asked on Aug 05th, 2023 on Domestic Violence - Ohio
More details to this question:
I was talking with this women potentially dating but we were still single and she was aware of that as well. I wanted to take things slow and ease in to us getting closer together. She gifted me two items a necklace and a bracelet for Valentine’s Day. I advised to her that she did not have to and I tried to give her back her gifts and she would not take them she told me to keep them. (I felt like she was trying to buy my love and I told her that). Two months down the line I was moving places and was not able to spend enough time with her. Now she is asking for her gifts back and if she does not get them she is going to file charges against me. I also have a two witness that can back that she gave them to me as a gift. Do I have to give it back?

The general rule in most states is that once a person has the intent to give a gift to another person, and relinquishes control, and dominion and possession of that property over to the other person, then the gift is completed, and it cannot be revoked. However, if a gift is given in contemplation of marriage, and the donee of said gift does not go through with the marriage, then the gift giver can sue for a return of the gift. This is the general rule, so you should call an attorney in your jurisdiction for more specific advice.
