Should I object to my husband who wants to tell the judge he has to get out of jail to help me with the kids?

My husband and his parents are going to file for divorce from me after he gets out of jail. Him and his lawyer are going to tell the judge he has to get out because he has to help me with our 3 children because of my medical problems. He said this when he called me from the jail when I told him no he was not going to say that he said he has to say whatever to get out of jail and that he would not go through with the divorce. Since I did not want him saying that, he guessed I wanted him to go to jail and I told him if he said that, then they could use that against me and keep my kids.
