signing over custody

More details to this question:
My mother and I have been raising my niece since she was 4. My brother has full custody of her though, how would we go about him signing over custody? The mother is not in the picture and has no rights to my niece, and my brother is in agreement with us of signing my niece over because he is equipped to take care of her. She's 8 years old.

Did the court terminate the rights of the mother? Your mother can file for a modification based on the fact that the child has been in the possession of your mother for over 6 months. However, you need to know the status of the mother of the child in case she needs to get notice of the modification.
