QUESTION

Someone Filed On My Behalf For Custody

Asked on Aug 12th, 2015 on Family Law - New Jersey
More details to this question:
Hello, I just recieved a notice in the mail that I am filing for custody of my children. I never filed this. It has down "Signature on file" I didn't even sign this! Is anyone else allowed to file a custody motion on your behalf? I do not have a lawyer and did not authorize this claim. It seems like someone went either online or into a state agency and pretended that I was filing for full custody of my children against my ex husband. We have an agreement already. Is this allowed or even legal? Thank you!

It sonds really fishy.  On the document there will be a docket number.  Call the County Court in the county in which you live and ask for the family division and give them the docket number and ask what is going on.  It may be a mistake, that you have an agreement but still need a formal application to the court.  The clerk will be able to help you.
