QUESTION

Stagnant Modification

Asked on Apr 23rd, 2020 on Family Law - Florida
More details to this question:
I have two open cases. Both in which custodial parents left orgin state (Florida) with child(ren) and relocated elsewhere. I have successfully filed a child support and visitation modification for one as of 12/30/19. My current lawyer (challenging) has advised me she was served out of state. Upon checking orgin state (Florida) court website it says "UNABLE TO ISSUE - DOES NOT MATCH CASE STYLE OF PETITION - PROVIDES INCORRECT ADDRESS FOR CLERK OF THIS COURT. " Does this mean they werent able to serve the custodial parent? Im leaning towards that her info isnt correct with the courts. Although I physically observed and reported current address of the custodial parent to my lawyer to use for filing. Should any of this be my problem? If so what should be my next steps.

It sounds as if the Clerk of Court was unable to issue the Summons to be served with your Petition because of a bad address for her. Check with your attorney to see if a new Summons (Alias Summons) needs to be issued.
