QUESTION

Step Parent Adoption

Asked on Oct 15th, 2013 on Adoptions - Florida
More details to this question:
Biological father of my 5 year old son is in jail and facing up to 28 years prison time for stabbing three women. He will be sentenced this November. My current husband has been in my son's life longer than the biological father was. My husband would like to adopt my son. We moved from Indiana to Florida 4 months ago and currently have a court agreement with the biological father's mother for grandparenting time, 4 visits per year. We would like this reduced as well during the adoption because the grandmother does not have my son's best interest in mind. My husband and I both work and our income is not that great. What would be the best way to get the adoption process started and would it require the bio father's consent in order for the adoption to go through? We would like the bio fathers rights terminated due to his violent past and drug abuse. I should also mention that the three stabbings happened in front of a 3 year old little boy and his mother was one of the victims.

are in you Florida and if so, what part?  The easiest way to do a step-parent adoption is by consent.  That is the cheapest way, as well.  You'll likely need an attorney to navigate the process.  Unless he agrees, it won't be easy or cheap even though his rights will likely be terminated in the end.
