More details to this question:
My husband was granted full custody of his daughter in February and the mother was to have supervised visitation every other weekend. The mother has only done 2 visits, and during the time that she doesn't see her, she doesn't call to see how she is. My husband also filed for child support and the mother said she could not pay it. Since then the mother has moved out of county and had her phone disconnected. There is no way of contacting her. Can her rights be terminated? Can I file for adoption without her consent?

yes and no.  there are cases where you can terminate rights in these circumstances, but you are going to need to serve her with paperwork.  It is unlikley the Judge would do it so quickly.  If after a signifigant period of time she continues to be missing, then you might have a better chance.  5 months is just not long enough to terminate rights.
