I was married in 2004 and separated in 2007. We both part ways and I had a child in 2013. My husband is not the father of my child because we never reconnected since our separation. We have no house, cars, or bank accounts to divide. We both agreeing on signing the divorce papers together. What are the steps to file a divorce?
Well, under Florida law, it is presumed that while you are married, that the husband is the father of any child born during the marriage. In order to overcome that burden, in addition to filing an uncontested petition for dissolution of marriage, there must also be a petition included to disestablish paternity.
