My brother gave me a 38" flat screen tv for my birthday. Now we are arguing and he is threatening to come and take back the tv that costs around $400.00, can he do that? Is there anything I can do to prevent that?

I think once the gift is given, it belongs to you and cannot be taken back. Moreoever, if your brother did take the gift without your permission it would be trespassing in your home.
