Tax Returns & Legally separated before divorce

More details to this question:
In 2011, I bought our primary NY residence from my ex in the final stipulation. In 2012 I paid all expenses for the primary NY residence and took major losses for Sandy. We filed NYS & Federal taxes jointly. Does NYS or the IRS/Federal require that the tax return distribution be 50-50?

If you're legally separated your separation agreement should discuss taxes. If it doesn't, you probably didn't have it reviewed by an attorney before signing it.
