Temporary Maintenance while living together

Asked on Dec 29th, 2013 on Divorce - New York
More details to this question:
I ve been married to my husband for 6 yrs, we have a 5 yr old daughter. We also live together. I recently discovered that he is gay. I would like to know, if i can get any financial support from him, while living together. I was laid off from the NYPD over 4 years ago. At the time, my daughter whose a cardiac patient and asthmatic was in and out of the hospital, so i remained home. Shes well now, and i have been searching for work, to move my daughter and myself out. However until i find a job, i will need the financial support. I will like to know all of my options.

Generally, you won't get maintenance or support until you separate, but depending on the facts of the other assets, you might be entitled to receive something from the marital home (if you own it). It also sounds like you would need some maintenance once the divorce is final to get you back to work. Talk to some lawyers in your area to get a more detailed response about the facts of your case. Good luck!

If you want a divorce, file for a divorce. Then you can seek support - though after a relatively short term marriage during which you worked you're unlikely to get spousal support for a great length of time. Child support is a different issue.
