QUESTION

Texas father's rights

Asked on Nov 22nd, 2016 on Family Law - Texas
More details to this question:
I wanted to know what my rights were in regards to taking my kids out of state with me and to my hometown in Kansas city. I am married and we have been arguing for months now and I feel it is in my kids best interest to be with me. I travel for work and not satisfied with the amount of care they have been receiving here at home. I'd like to take them with me while we settle on a mutual agreement for custody but I don't want to break the law by taking them.

If there are no orders in place, there is no law against you taking your children with you. However, the mother may file suit in Texas to ask the Court to order a geographic restriction. You could do the same in Kansas City once you get the kids there. You will have to show that they are safer in Kansas City than they were in Texas, depending on who files when and where.
