Mr. Eley, I live in Virginia. My husband and I are going through separation and fearing that he could get half of my house, I sent him a text stating that I would give up rights to Spousal Support, his new car and half of his 401k. It was months later that he had paper drawn up, at which time I had changed my mind. ARE THOSE TEXT MESSAGES BINDING IN COURT OR SINCE I DIDNT SIGN THE PAPERS, CAN I STILL PURSUE SPOUSAL SUPPORT? Your texts are likely not binding as far an an agreement goes, but an attorney would need to review the exact wording to be sure.  More likely, they are privileged settlement negotiations.
