QUESTION

Timeshare ownership

Asked on Jun 20th, 2016 on Divorce - New Jersey
More details to this question:
Been divorced since 2011. My ex and I had 2 timeshares that we agreed to take ownership of one each (in the PSA). Here is my dilemma. Mine was in the Caribbean and I did all the necessary paperwork to get her name off the deed at my cost. She has not done it and my name is still on the deed. As a result, I cannot have a private account as Marriott (nor the exchange company Interval) will not split ownership account as I am still on the other deed. My question is, if I file a motion, will the court force her to do this AND can I get reimbursed council fees. All the PSA says is I take ownership of 1 and she the other. Thank you for your help.

most likely that wll occur.  You can file a motion to enforce, and ask for fees and costs.  You should start by sending a letter to your ex's attorney and demanding that the terms of the PSA be completed.
