QUESTION

To whom am I legally married?

Asked on Jul 20th, 2015 on Family Law - Indiana
More details to this question:
In 2006, I was married in the state of Arizona in a rural community. In 2011, after moving back to my home state of Indiana, I contacted the clerks's office in the AZ county to obtain a copy of that marriage license in order to file for divorce. I was told by the County clerk's representative that the license was not properly filed by the officiating clergy (chapel) and that statues of limitations rendered that ceremony mute since the license was not filed. I could not find a copy of the official license and could not remember receiving one. My attorney in Indiana therefore, decided no divorce was necessary - seperation and property division had occured in 2010 and was complete. My former husband agreed. I remarried in 2012 in Indiana believing myself to be a single woman. Last week, my former husband from Arizona, produced the original marriage license, certified and filed with the AZ court in July 2006. I have seen it. To whom am I married, and what do I do?

It appears that you are still legally married to husband #1 if you have already confirmed with the AZ clerk that this license is valid. I would certainly question why you were told otherwise!  Your marriage to husband #2 is likely void.  You should contact an attorney in AZ and file for divorce - or maybe husband #1 will take care of filing and it can be done in a cooperative manner.  Once that divorce is granted, you should remarry husband #2 - if you want to!
