QUESTION

TPO Visitation rights and violations

Asked on Dec 23rd, 2013 on Domestic Violence - Georgia
More details to this question:
I was granted a TPO recently and now my ex is making visitation demands through the assigned contact person for pick up and drop off of our child. He had someone right down dates and times on a piece of paper to give to me, even to the point of stating that he already bought airline tickets for one vacation coming up, this vacation time falls on his assigned weekend but it also includes 2 days out of school for him which I am not very happy about let alone not trusting the ex for, as it could come back and bite me. He has also sold the idea to our child to make me look bad if I say no. Do I have any recourse considering all the order states was his assigned weekends, no vacations holidays etc were discussed

Unfortunately, this is difficult to answer and the best advice is to talk to a local lawyer. It sounds like he very well may be in violation of the TPO which I assume does not give him visitation for the entire period he wants to take the vacation. On the other hand, the order may not be specific about him needing permission to leave town. You may need to file a new petition with the court to have it clarified.
