QUESTION

Uncontested divorce vs dissolution

Asked on Jul 12th, 2017 on Divorce - California
More details to this question:
Hello- me and my wife have been married for four years and now considering getting a divorce in California. We do not have children or own assets- we have a car loan together for 10k remaining and some months remaining on our apartment lease which amounts to 5k. We both want to end this fairly and smoothly and as quick as possible- does uncontested divorce make sense ? Or summary dissolution? Do we split the debt of car/lease since those happened after the marriage and we both share them? Although we are ending marriage because of irreconcilable differences and want to end it smoothly - still there is so much info out there one is easily lost. I don't know where to star I feel lost and emotionally drained so any helpful experience advice would be greatly appreciated

A uncontest divorce means that you and your wife are in agreement and have resolved any issues. A contested divorce means that you do not agree and you want the court to decided. Dissoultion of marriage is the legal process of filing for a divorce in California. All dissolution of marriage actions are either contested or uncontested. Based off of your post it seems that you two could file for a dissolution of marriage and then enter into a joint stipulation of judgment.
