If the mother is withholding visits, file a petition in Family Court seeking to enforce the prior order or, if you have no prior order, seeking visitation. If there is an ACS investigation, that information will be provided to Court. You will have a chance to defend yourself. Further, if you are paying child support, consider filing a motion to suspend support due to the mother's refusal of access. You will have to keep paying support until the court orders a suspension. Talk to some lawyers near you to get a better idea of all your options. Good luck!
