My husband and I were living separated in the same house for 3 years because we neither of us could afford to leave. I got a promotion and was able to move out. WE both have been doing ok. He has filed for divorce and I was basically walking away from everything. His lawyer now says I gave to give him child support. Can he waive it since he got the house? If it is in the best interest of the child ? We had a really good relationship up until this point where he is going for child support. If I go for custodial parent will that help not have to pay him?

The amount of child support is based on the parenting plan and the incomes of the parties. The child support is the right of the child and the Court is unlikely to waive the requirement unless the parties provide the court a reason to deviate from the guidelines.
