What can I do if there aren’t any papers saying who my kids would live with but I can’t see them?

My hubby had a DVP on me that I wasn’t allowed around him. We got back together and when I went out one night with friends after work, he told me not to come home because I would be put in jail. Now we’re going through this divorce. He has my sons, won’t let me see them or spend any time with them at all. I NEED HELP! I don’t have the money to get a lawyer to fight him. He has one. I’m going to lose my kids so I’m teaching myself the laws.

You need to file a motion for visitation immediately. Inform the judge that you are not allowed to visit with your children and that you are requesting parenting time with them.

You should do your best to borrow the money to hire a lawyer. In a divorce you would ordinarily seek a temporary order which would provide for periods of placement of the children with each parent. If you insist on doing this yourself, review the sections of Chapter 767, Wisconsin State., which will tell you the procedure for seeking a hearing on a temporary order.

File for custody hearing or to modify protective order. You really need an attorney to help you know which way to get some custody even if its supervised. Borrow money and find a limited scope attorney just for advice if you want to get your kids back.

In Ohio you would be in over your head. You need a lawyer. Please contact the local Legal Aid Society, the local bar association, and if all else fails, contact law firms from the yellow pages. I strongly suggest you not try to fight this without assistance.
