QUESTION

What do I do in case of interstate kidnapping?

Asked on Apr 08th, 2018 on Child Custody - Louisiana
More details to this question:
My ex lives in alabama. I live in Louisiana. My daughter nor I have ever lived in Alabama. During her Easter visit there he filed emergency custody. He lied about every part of the petition including that Ive stayed in Alabama periodically. Our custody was done in Louisiana where I live. He was not happy with the judges ruling so he made the very same accusations on the Emergency order that he made at our custody trial in 2016. How do I get my daughter back? This is unreal and unfair. I feel failed by the system.

Cristy, sorry to hear what you are going through. However, emergency orders are granted by default without trial. You should have retained an attorney to respond to the petition that your child father alleged and served. You have to  figure out if the court has jurisdictio if it does than you have to fight the battle all over again. But a competent and aggressive attorney can assist you in any case. If you can not afford an attorney, you can represent yourself in court. Feel free to contact my office and speak with a case manager at 877-866-8665 or email help@smsattorneys.com for clarification.
