QUESTION

What is considered while school is in session?

Asked on Feb 27th, 2013 on Family Law - Texas
More details to this question:
My ex always seems to give me a difficult time as to what is considered while school is in session. For instance if my child has an off day from school whether its a student holiday or teacher in service date she considers that while school is in session. To me there is no school so it is considered when school is not in session. This may seem petty but our visitation times go by this and she gives me a hassle every single time. At times she says schools not in session so you need to come pick him up or school is not in session so I will bring him. I would just like to get to the bottom of this in and out of school session meaning.

Normally there would be a provision in the Final Decree of Divorce that adds the days school are not in session to that parent's visitation.  You would have to review your decree.  Also there is normally language that says that the school district where the child goes to school is the district for determine holidays.  If you cannot work this out, you need to see an attorney who can review your documents and to advise you if you should file legal proceedings.
