Emancipation is a legal status wherein a minor attains full legal rights and obligations as an adult. Under Florida law, there are a number of ways to become emancipated. Among these ways are the following: You may be legally married in Florida or another state, attain the age of eighteen years, or be declared emancipated by a circuit court judge in a legal proceeding. Assuming you are interested in the last method, you would need to file a Petition in the circuit court where you reside and state the reason you are requesting the court to declare you to be an emancipated adult. You will need to serve the court papers (the Petition) on your parents or legal guardian(s) an they will have twenty days to file a response with the court, referred to as an Answer. Assuming you successfully show the court the reasons for your emancipation and there are no other reasons to deny your request (for example, if there are pending criminal charges against you in juvenile court or you have other impediments), the court will hold a hearing to take evidence to support or oppose your Petition. ‘Evidence’ consists of documents and papers as well as the testimony of witnesses. Thereafter, the court will enter a final judgment and, if successful, you will be an emancipated adult at that time.
