what rights does a father have?

More details to this question:
They aren't married but lived together. She left relationship. His name is on birth certificate. She says he legally can't take baby on a vacation out of state. They haven't been to court. Does she have more rights than the dad?

Children born out of wedlock are by law, in the legal custody and control of the mother.  Biological fathers (Bio-Dads or Baby Daddy if you will), must file a legitimation proceeding and have a court hearing to have any legal rights to the child(ren).

Until the child is legitimated via a Superior Court Order, the father has NO rights whatsoever to the child.
